Overstock.com e-Gift Card Terms and Conditions
The Overstock.com Gift Card may only be used to buy goods or services under the "Shopping Tab" at Overstock.com (shortcut o.co) and O.biz. Card balance cannot be used for the purchase of other gift cards, cellular phone plans or international orders. Not redeemable for cash in New Jersey, or in any other state unless required by law. Not a credit or debit card. Not reloadable. Safeguard your card - it will not be replaced or replenished if lost, stolen or used without authorization. CardFact V, Inc. is the card issuer and sole obligor to card owner. CardFact may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not CardFact, will be the sole obligor to card owner. Purchase, use or acceptance of an Overstock.com Gift Card constitutes acceptance of these terms.

The Overstock.com Gift Card may be purchased in both a physical and electronic format. To purchase a physical Overstock.com Gift Card, click here. To purchase an electronic Overstock.com Gift Card, click here.
The amount used from any Overstock.com Gift Card toward a purchase will be deducted from the Overstock.com Gift Card balance upon use. Any unused balance will be placed in the recipient's "Gift Card Balance" which can be located by clicking on "My Account" and then clicking the "Account Settings" tab. If an order exceeds the amount of the Overstock.com Gift Card, the balance must be paid with a credit card or other available payment method. To view your Overstock.com Gift Card balance, click on "My Account" and then the "Account Settings" tab.
- The Overstock.com Gift Card may only be used to purchase goods or services under the "Shopping Tab."
- The Overstock.com Gift Card may not be used to purchase other Overstock.com Gift Cards.
- The Overstock.com Gift Card may not be used to purchase cellular telephone plans.
- The Overstock.com Gift Card may not be used for international orders.
- The Overstock.com Gift Card cannot be reloaded, resold, transferred for value, redeemed for cash or applied to any other account, except to the extent required by law.
- Unused Overstock.com Gift Card balances may not be transferred after the Overstock.com Gift Card’s balance is loaded into the "My Account" as described above.
- The Overstock.com Gift Card may not be used for illegal or fraudulent transactions.
- Expiration & Fees
The Overstock.com Gift Card does not expire and has no fees.
- Risk of Loss
Take caution to safeguard the Overstock.com Gift Card. The risk of loss and title to the Overstock.com Gift Card passes to the purchaser or intended recipient upon tender to the carrier (in the case of a physical Overstock.com Gift Card) or upon transmission (in the case of an electronic Overstock.com Gift Card). If the Overstock.com Gift Card is lost, stolen or used without authorization, it will not be replaced or replenished. We are not responsible if the Overstock.com Gift Card is lost, stolen, destroyed or used without the purchaser or recipient’s permission.
We reserve the right to close customer accounts and bill alternative forms of payment if a fraudulently obtained Gift Card is redeemed and/or used to make purchases.
- Limitation of Liability
Overstock.com, Inc., including its affiliates and subsidiaries, make no warranties, express or implied, with respect to Overstock.com Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event an Overstock.com Gift Card is non-functional, your sole remedy, and our sole liability, shall be the replacement of such Overstock.com Gift Card. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. Accordingly, some of the foregoing limitation of liability provisions may not apply to you.
Any and all disputes relating in any way to Overstock.com Gift Cards shall be submitted to confidential arbitration in Salt Lake City, Utah, USA., except that, to the extent you have in any manner violated or threatened to violate Overstock.com’s intellectual property rights, Overstock.com may seek injunctive or other appropriate relief in any state or federal court in the State of Utah, USA and you consent to the exclusive jurisdiction and venue in such courts. Arbitration shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise.
Overstock.com Gift Cards are issued by CardFact V, Inc. ("CardFact"). CardFact is the sole obligor to the purchaser. CardFact may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not CardFact, will be the sole obligor to the Gift Card owner.
Overstock.com reserves the right to change these terms and conditions from time to time in its sole discretion, and any purchase of an Overstock.com Gift Card after such change shall constitute acceptance to these terms and conditions.
